Gov. Kathy Hochul Signs Legislation Expanding Cannabis Farmers Market Program in New York

Last week, Governor Kathy Hochul signed two companion bills that expand New Yorks cannabis farmers market program, further bridging the gap between cultivators, processors, retailers, and consumers. This will likely bolster local cannabis businesses and improve consumer access by introducing more flexible event opportunities across the state.

The bills, introduced by Senator Michelle Hinchey and Assemblymember Donna Lupardo, address ongoing challenges in New York’s cannabis market and create new opportunities for cannabis businesses to thrive. These adjustments build on the original cannabis farmers market framework, first implemented in 2023 as a solution to the state’s slow adult-use marijuana rollout.

A Refreshed Vision for Cannabis Showcase Events

The new laws define and expand cannabis showcase events, taking the concept beyond traditional farmers markets. These showcase events now legally include new formats, such as stand-alone “pop-up” markets, designed to provide even more public access to regulated cannabis products. Vendors participating in these events will feature more than just cannabis; they can also spotlight branded merchandise and educational materials, building upon consumer knowledge and engagement.

Retailers can host these events in partnership with at least one licensed cultivator and processor. Importantly, the legislation removes the cap on how many retailers can participate in a single showcase event, provided each one meets partnership requirements.

The bills clarify that products sold at these showcase events must include the contributions of licensed cultivators and processors involved in the event. However, organizers are not allowed to selling only those specific products, allowing a wider variety of cannabis-related goods to be showcased.

Although dispensaries have started to open across the state since the program’s initial rollout, these pop-up showcase events aim to serve as an additional outlet for licensed businesses, ensuring accessibility for smaller enterprises while continuing to attract a broader consumer base.

Addressing the Challenges of the New York Cannabis Market

The original cannabis farmers market initiative was born out of necessity. The slower-than-anticipated licensing approvals and legal hurdles initially left many cannabis cultivators in limbo, with harvested products but no storefronts to sell them. Though the retail market has grown since then—with New York surpassing $1 billion in sales since legalization began—licensed cannabis businesses continue to face hurdles like steep start-up costs and unlicensed competition. Additionally, the revisions come with an increased focus on compliance. Participating businesses now require permits for every showcase event and must adhere to updated application processes. This includes identifying their licensed cultivator and processor partners for each event.
