South Africa- On Tuesday, South African President Cyril Ramaphosa signed the Cannabis for Private Purposes Act (CfPPA) into law, a piece of South African cannabis legislation that regulates the cultivation, possession, and use of cannabis by adults in private settings.
This new law marks a pivotal moment in the country’s approach to cannabis, aiming to provide a clear legal framework for its use and reduce the criminal penalties associated with cannabis-related activities. The CfPPA addresses various aspects of cannabis use, including guidelines for personal cultivation, permissible quantities for possession, and the conditions under which cannabis can be consumed.

South Africa’s Road to Cannabis Legalization
The journey to cannabis legalization in South Africa has been long and complex. Following the 2018 Constitutional Court ruling, lawmakers had a two-year deadline to amend existing legislation. They introduced the bill to legalize cannabis in 2020, but delays and political hurdles slowed its progress.
Despite these challenges, the National Assembly approved the bill in November 2023, and the National Council of Provinces followed suit in February 2024. The President’s signature on the CfPPA came just one day before national elections.
A New Era for South Africa Cannabis in South Africa
The South Africa Cannabis Legalization bill known as the Cannabis for Private Purposes Act is designed to provide a regulatory framework for the private use of cannabis by adults. Among its key provisions, the CfPPA:
- Removes cannabis from the Drugs and Drug Trafficking Act.
- Allows amendments to the Schedules of the Medicines and Related Substances Act.
- Facilitates targeted regulatory reforms in various agricultural and industrial legislation, such as the Plant Breeders Rights Act and the Plant Improvement Act.
These changes aim to pave the way for the industrialization of the cannabis sector, potentially unlocking significant economic opportunities for South Africa.
“The consequent regulatory reform enabled by the CfPPA will, amongst others, entirely remove cannabis from the Drugs and Drug Trafficking Act. This will further enable amendment of the Schedules to the Medicines and Related Substances Act and provide for targeted regulatory reform of the Plant Breeders Rights Act and the Plant Improvement Act, as well as other pieces of legislation that require amendment to allow for the industrialisation of the cannabis sector.” via a press release by President Cyril Ramaphosa.
Key Provisions of the Cannabis for Private Purposes Act
Cultivation and Possession
The new law permits adults to cultivate and possess cannabis for personal use within their private residences. This move seeks to uphold the Constitutional Court’s 2018 ruling that the prohibition on the private use and cultivation of cannabis was unconstitutional. The CfPPA brings much-needed clarity and structure to this previously grey area.
Children in Mind
One of the critical concerns addressed by the CfPPA is the protection of children. The Act includes detailed guidelines on the medically prescribed administration of cannabis to minors while safeguarding them from undue exposure to cannabis. It also establishes alternative approaches to handle cases involving the prohibited use, possession, or dealing of cannabis by children.
“The Bill further guides the medically prescribed administration of cannabis to a child while also protecting children from undue exposure to cannabis. It provides for an alternative manner by which to address the issue of the prohibited use, possession of, or dealing in, cannabis by children, with due regard to the best interest of the child.” via press release from the President.
Prohibition of Cannabis Sales
Contrary to what some might expect, the CfPPA does not legalize the sale of cannabis. Adults are required to grow their own plants, and consumption is strictly limited to private settings. This provision aims to control the spread and commercialization of cannabis while still respecting individual freedoms.
Expungement of Criminal Records
In a move lauded by many, the CfPPA provides for the expungement of criminal records for individuals previously convicted of cannabis possession or use. This measure represents a step towards social justice, offering a fresh start to many who the old laws penalized.
