Missouri Revokes Delta Manufacturing’s License After Major Product Recall

The cannabis industry in Missouri has been rapidly growing since the state legalized medical marijuana in 2018. However, with this growth comes the need for common sense regulations to ensure the safety and integrity of cannabis products being sold to consumers.

Unfortunately, one company has recently made headlines for violating these regulations, leading to a major product recall and, ultimately, the revocation of their manufacturing license by the Missouri Division of Cannabis Regulation (DCR) which says that revocation of Delta Extraction is “credible and imminent threat to public health or public safety.”

Delta Extraction, a company based in Missouri, made headlines in August when the Department of Health and Senior Services (DHSS) issued a product recall for over 60,000 cannabis-infused products. These products contained distillate that was manufactured and sold by Delta Extraction and its affiliates.

As a result of the recall, Missouri regulators suspended Delta’s business license on August 2. This was just the beginning of their legal troubles with the state.

Violations by Delta Extraction According to Missouri DCR

The initial violation that led to Delta’s license suspension was their use of out-of-state, hemp-derived THCA to manufacture infused products destined for Missouri store shelves. Which according to the Missouri DCR is in direct violation of state law.

Further investigations by the DCR uncovered additional violations per a press release:

  • Failed to ensure that all marijuana product sold in Missouri originated from marijuana grown and cultivated in a licensed cultivation facility located in Missouri
  • Failed to ensure that all tetrahydrocannabinol (“THC”) in marijuana product is derived from marijuana cultivated by a Missouri licensed cultivator
  • Failed to comply with seed-to-sale tracking requirements and falsified seed-to-sale tracking data
  • Failed to ensure all product in its facility is traceable in the statewide track and trace system at all times
  • Due to falsification of tracking data, the Licensee failed to ensure all marijuana product from its facility is compliantly tested before transfer to a dispensary facility
  • Due to falsification of tracking data, the Licensee also packaged marijuana in a false and misleading manner
  • Failed to maintain security of marijuana product and the facility by failing to comply with required security measures and failing to maintain required security equipment

Because of the violations, license of Delta Extraction, LLC license with be revoked and take effect on Dec. 2, 2023.
