One Step Closer to Recreational Cannabis in Minnesota

On Friday, April 28th, the Minnesota Senate voted 34-33 along party lines to pass a bill to legalize recreational cannabis for adults 21 and up. All Democrats voted in favor, while all Republicans voted against it. Although similar to the version of the bill already passed by the House earlier this week, there are some slight differences.

The bill was introduced by Senate Majority Leader Paul Gazelka and supported by Senator Jeff Hayden, who said it was an important step forward in addressing racial injustice and correcting the harsh punishments for cannabis-related crimes. In addition, supporters of the bill believe it will create jobs, generate revenue, reduce criminalization, improve public health and safety, and foster economic development.

Both houses have already agreed on many aspects of the bill but must still agree on details such as the tax rate and local government control. It is also unclear whether any amendments will be made to address opponents’ concerns regarding minors’ access to marijuana and implications regarding impaired driving.

Recreational Cannabis

The Senate’s version includes a 10% tax on cannabis products, while the House bill proposed an 8% gross receipts tax over four years. Additionally, local governments could limit the number of cannabis businesses in their areas under the Senate’s plan but not the House’s proposel. Furthermore, the Senate allows people to possess up to 5 pounds of cannabis in their homes instead of 1.5 pounds which the House sets.

Opponents of the bill have concerns about its potential impact on minors’ access to marijuana and its implications regarding impaired driving. They also worry that legalizing recreational marijuana could lead to an increase in drug abuse and addiction. On the other hand, supporters of the bill believe it will create jobs, generate revenue, reduce criminalization, improve public health and safety, and foster economic development.

Supporters of the bill are hopeful that with a few tweaks, they can reach an agreement between both chambers in time for it to become law this year. This is important because if the two sides cannot agree on a plan, any progress made so far will be lost when a new legislative session begins.


If the Minnesota bill to legalize recreational marijuana for adults 21 and older is passed by both chambers, Governor Tim Walz will likely sign it into law.

Governor Walz has strongly supported the effort to legalize cannabis, stating that he believes it “can be done right with thoughtful regulation.” He has also previously expressed his belief that legalizing recreational marijuana would help reduce racial disparities in the criminal justice system.


The governor’s office has stated that if the bill passes both houses, they are ready to create a framework for safe and responsible adult-use cannabis. This includes implementing safeguards against impaired driving and ensuring access to legal products to reduce any potential impact on youth access.

The bill’s progress so far is a positive sign that Governor Walz will soon be able to sign it into law, bringing an end to decades of prohibition in Minnesota. However, it remains to be seen how long it will take for all regulations and safeguards to be put in place before recreational cannabis is officially available for purchase within the state.

This is reflective of the larger trend of marijuana legalization around the nation, where states that are solidly Democratic have moved towards full legalization or decriminalization. In contrast, Republican-controlled states have been slower to act, if at all.

Nevertheless, it shows that even with tight margins, progress is possible regarding cannabis reform. There has been an overall shift in public opinion on marijuana in recent years, with more and more people supporting legalization efforts nationwide. The success of the Minnesota bill could be seen as a sign of things to come.
