Despite the public approval—71% and 67% of votes in favor—the measures faced legal opposition led by former state senator John Kuehn and Nebraska Secretary of State Bob Evnen. Allegations of misconduct during the petition signature-gathering process fueled a lawsuit intended to invalidate the ballot measures. However, Judge Strong ruled that the challenges lacked sufficient evidence to warrant overturning the initiatives.

The legal case against the medical marijuana initiatives centered on claims of misconduct during signature gathering. Allegations included fraud by petition circulators, improper notarization of signatures, and potential violations of statutory requirements. Nebraska law mandates a minimum of 86,499 valid signatures for such measures to qualify for the ballot. The Nebraskans for Medical Marijuana campaign exceeded this threshold by nearly 3,500 signatures for both petitions, according to official certification by Secretary of State Evnen.

During a four-day trial, evidence presented included testimony from petition circulators and a review of thousands of gathered signatures. The plaintiffs argued for invalidating entire batches of signatures associated with alleged misconduct.

However, Judge Strong dismissed these claims as insufficiently substantiated. She concluded that, while isolated violations occurred, they were not indicative of pervasive or coordinated wrongdoing capable of disqualifying the petitions.

Judge Strong’s 57-page decision below (provided by the Nebraska Examiner) emphasized the importance of adhering to constitutional and statutory requirements for ballot initiatives. She noted that of the challenged petitions, only 711 signatures from one initiative and 826 from the other lost their presumed validity. Even with these disqualifications, the petition campaign retained more than enough valid signatures to meet the required threshold.

Addressing the broader claims of systematic misconduct, Strong stated, “The plaintiffs fell well short of demonstrating widespread fraud.” Her ruling upheld the petitions’ legal sufficiency, allowing the measures to proceed for certification and eventual implementation.

A spokesperson for the Nebraska Attorney General’s Office has indicated that an appeal to the state Supreme Court is under consideration. Crista Eggers, campaign manager for Nebraskans for Medical Marijuana, praised the court’s decision, saying, “Many years of hard work have gone into this effort. Knowing that another mother will soon have an option for her suffering child makes it all worthwhile.”

With voter certification expected to conclude in December, Nebraska is closer than ever to joining a growing number of states offering legal and regulated access to medical marijuana.

The court’s decision not only clears a legal hurdle but also highlights the strength of Nebraska’s democratic process.
