Nevada Sees Positive Changes Via Legislature

The Nevada legislature recently approved several bills that provide a much-needed boost to the cannabis industry. The changes signed into law last month by Gov. Joe Lombardo include eliminating and capping various fees, reassessing penalties for operating violations, creating a dual license for retailers serving medical patients and recreational consumers, and reducing maximum fees for nearly every marijuana license.

The new legislation was designed to reduce the economic burden on operators, incentivize compliance and cooperation, and provide benefits for cannabis consumers. These changes are expected to have a positive impact on the state’s cannabis market as well as its economy overall. Industry professionals are optimistic that this will help Nevada’s businesses recover from the disruptions caused by the pandemic.

The new laws also bring more clarity to the cannabis regulations in Nevada, making it easier for businesses to comply with the requirements and allowing the state’s supply chain to operate more smoothly. This will encourage investment in the industry, leading to more significant economic opportunities for everyone involved.

Senate Bill 195

Senate Bill 195 (SB195) introduced several changes to Nevada’s cannabis regulations that are designed to reduce the burden of excessive fines and fees. The bill eliminates the practice of “stacking” different types of violations, which has caused many marijuana businesses to be hit with outrageous fines. According to the Nevada Cannabis Compliance Board (CCB), this was a significant problem within the state’s industry.

Under SB195, the CCB is also prohibited from invoicing cannabis businesses and applicants for so-called “time-and-effort” charges for normal business interactions with regulators, including document reviews and compliance inquiries.

The bill also reduces the maximum penalty fees for nearly all cannabis-related offenses in Nevada from $90,000 to $20,000. This is expected to make it easier for companies to remain compliant and give them more breathing room when it comes to their operating costs.

Senate Bill 277

Senate Bill 277 (SB277) also provides numerous benefits to Nevada’s cannabis industry. The bill creates a dual license for retailers, allowing them to serve any type of customer, including medical and recreational consumers. This will be beneficial for about one-third of the state’s 100 cannabis retailers, who can now expand their market offerings.

In addition, SB277 increases the purchasing limits of cannabis flower from 1 ounce to 2.5 ounces and the purchasing limits of cannabis concentrates from an eighth of an ounce to a quarter of an ounce. This will benefit retailers and consumers alike as it gives them more flexibility in product selection.

The increased purchasing limits are also expected to benefit Nevada’s roughly 12,500 medical marijuana cardholders, as they now have more options for their medicine. This is in addition to the cultivators, processors, and distributors who will also benefit from the expanded market.

Nevada has made substantial strides in reforming its cannabis industry with the passage of Senate Bills 195 and 277. These developments not only demonstrate a more lenient approach toward cannabis operations but also reflect an understanding of the economic potential that the industry holds.

Most importantly, they pave the way for a more fair, equitable, and prosperous sector. The hope is that these positive changes in Nevada serve as a beacon for other states, underlining the potential benefits of restructuring their cannabis regulations.
